Terms and conditions
Version dated 14 October 2026
1. Scope and seller
These terms and conditions apply to purchases of goods through digilema.de. The seller is Gelardo OÜ, Jõe tn 9, Kesklinna linnaosa, 10151 Tallinn, Harju maakond, Estonia, registered in the Estonian Commercial Register under registration number 17038053, VAT identification number EE102899009, represented by Andrei Buivolov, Member of the Management Board.
Email: info@digilema.com; telephone: +372 5743 1807.
The special consumer rights in these terms apply to individuals ordering predominantly for purposes outside their trade, business or profession. These terms do not grant business customers a statutory consumer right of withdrawal. They do not reduce any statutory rights.
2. Ordering and formation of the contract
The display of goods in the shop is an invitation to place an order. You can add goods to your basket, change quantities and remove goods. During checkout, you enter your contact, billing and delivery details and choose an available delivery and payment method. Before submitting the order, you can review your entries and the total amount and correct errors by editing the relevant fields or returning to your basket.
By using the final order button, which clearly indicates the obligation to pay, you submit a binding offer to buy the listed goods. We acknowledge receipt of your order by email. A message that only acknowledges receipt does not itself accept your offer.
We accept your order when we receive full payment, including the agreed delivery costs. The purchase contract is formed at that time. For an online payment, this means a successful charge confirmed by the payment service provider; payment authorisation alone is insufficient. For a bank transfer, it means the funds being credited to our account. If we dispatch the goods earlier, the contract is formed no later than dispatch.
Contracts can be concluded in German or English. The language you select when ordering applies to your contract. We store the order details and email you a contract confirmation containing the order details, the terms applicable when the contract is formed, the withdrawal information and the model withdrawal form in a format you can save. Please retain these documents. We do not promise permanent online access to the complete contract text; you can contact us about your order.
If an item is unavailable before a contract is formed, we will inform you and will not accept the order for that item. Once a contract has been formed, delivery problems and pricing or input errors are governed by statutory rules. These terms do not give the seller a discretionary right to cancel an existing contract.
3. Prices, delivery charges and payment
Prices are in euros and include the applicable VAT. The total displayed before you submit your order includes the taxes applicable to the delivery country and the delivery charges.
Delivery within Germany is free of charge for all orders, with no minimum order value. This applies to the offered DPD home delivery and delivery to an available DPD pickup point. The delivery methods available for your address are displayed during checkout.
You can use the payment methods displayed during checkout. Availability may depend, in particular, on the delivery country, your device and the payment service provider. For bank transfers, payment instructions are provided with the order acknowledgement; please use your order number as the payment reference. Payment is required in advance. Online payments are also subject to the payment service provider’s terms shown during payment, without restricting your statutory rights against us.
4. Delivery
We deliver only to addresses in Germany using the DPD methods offered during checkout. You may select a pickup point where this option is available for your delivery address.
For goods marked as in stock, delivery normally takes 2–4 working days after payment has been confirmed, unless a different specific delivery period is stated for the item and before you place your order. Working days are Monday to Friday, excluding public holidays at the delivery destination. The period starts on the day after payment has been confirmed. Any different delivery period is disclosed before your order and forms part of the contract. A specific delivery period is agreed before ordering goods that are not in stock.
For consumers, where goods are sent using a carrier offered by us, we bear the risk of accidental loss or damage until the goods are handed to you or a third party you have designated to receive them.
Please tell us about visible transport damage promptly where possible and document it if you can. This is not a condition for your statutory rights: failure to report or document damage does not cause you to lose those rights.
5. Withdrawal and returns
Consumers generally have a fourteen-day right of withdrawal from distance contracts. The conditions, time limits, statutory exceptions and model withdrawal form are set out in our withdrawal information. You may withdraw, in particular, by email or letter, or by using the online withdrawal function described there.
Address for returning goods: Gelardo OÜ, Lao 15, 74114 Maardu, Estonia. This address for receiving goods is separate from our business address in Tallinn.
For an ordinary withdrawal, you bear the direct cost of returning the goods. For a justified claim concerning defective goods or an incorrect item sent by us, we bear the costs required by law. Contacting us first can help us arrange a defect claim, but withdrawal and its timely exercise do not depend on obtaining return authorisation.
6. Statutory rights for defective goods, digital elements and guarantees
You have statutory rights against Gelardo OÜ as the seller if goods are defective or do not conform to the contract. For new goods, the statutory limitation period is generally two years from delivery. Any longer statutory periods, extensions and rules preventing expiry remain unaffected. An additional manufacturer’s guarantee does not replace or restrict these rights.
Subject to the statutory conditions, consumers may initially choose repair or replacement. A particular remedy may be refused only where the law permits. We bear the necessary costs of bringing the goods into conformity, including transport, travel, labour and materials. Where provided by law, you may request an advance for expenses that we must bear. The remedy must be provided within a reasonable time and without significant inconvenience. Subject to the statutory conditions, you may also be entitled to a price reduction, termination of the contract and damages.
Where German consumer sales law applies, a defect that becomes apparent within one year of handover is generally presumed to have existed at handover, subject to the statutory exceptions and special rules for digital elements. If a defect is remedied by repair as a statutory remedy, the original limitation period is extended once by twelve months. Before providing a remedy, we will inform you of your statutory choice between repair and replacement and of this extension for a repair. Any more extensive mandatory rights under the law applicable to you remain unaffected.
For goods with digital elements, such as devices requiring software, the statutory duties to provide necessary updates and information about those updates also apply. These terms do not impose a general two-year limit on the legally required update period. Agreed characteristics, compatibility, functionality and any minimum software update periods communicated by the manufacturer are also specified in the product information provided before ordering.
Please report defects to info@digilema.com. Your order number, a description of the problem and photos, if available, are helpful. Your statutory rights do not depend on keeping the original packaging or presenting a particular original receipt if the purchase can be proved in another way. These terms do not impose a general two-month deadline for reporting a defect. Software faults, opened packaging or repairs by third parties do not automatically exclude all statutory defect rights; the applicable statutory conditions and the cause of the particular defect determine your rights.
A voluntary manufacturer’s guarantee or an expressly promised additional seller’s guarantee applies only under its stated guarantee conditions. These identify, in particular, the guarantor, coverage, duration and claim procedure. Your statutory rights for defective goods remain available independently and free of charge.
7. Liability
Our liability is governed by statutory rules. These terms introduce no additional exclusion or limitation of statutory liability.
8. Complaints, privacy and statutory rights
For questions and complaints, contact us at info@digilema.com, by telephone on +372 5743 1807, or by post at our business address: Gelardo OÜ, Jõe tn 9, Kesklinna linnaosa, 10151 Tallinn, Harju maakond, Estonia. Please send goods to the returns address in Maardu stated in section 5.
Your statutory options for contacting a competent alternative dispute resolution body or a court remain unaffected. These terms do not create a voluntary commitment to participate in a particular dispute resolution procedure; any participation required by law remains unaffected.
Information about the processing of personal data is available in our privacy policy.
The applicable law and court jurisdiction are determined by statutory rules. These terms contain no choice-of-law clause or exclusive jurisdiction agreement. Mandatory consumer rights, in particular under the law of your country of habitual residence, are not restricted.
